czkowska-Hernik responds to tonight's Tribunal takeover by issuing her own "order" suspending Prime Minister Donald Tusk.
The letter copies the format and legal reasoning of the order Anna Korwin-Piotrowska, a Tusk-backed judge whom President Nawrocki never swore in, used earlier tonight to suspend the head of the Constitutional Tribunal. Korwin-Piotrowska claimed authority as the court's longest-serving judge. Zajฤ
czkowska-Hernik claims the same as the longest-serving MEP born in January 1990, citing provisions with "analogous legal force."
Her stated reasons: using uniformed services to settle political disputes, installing the Prime Minister's "right hand" in the Tribunal, coordinating with prosecutors and police to remove judges Tusk dislikes, and choosing to do it just before All Saints' Day, when Poles traditionally set politics aside to honour their dead.
"I trust that this letter will be treated with the same seriousness as that scrap of paper from Ms. Korwin-Piotrowska."
Her point: if a judge whose appointment was never completed can suspend the head of the Constitutional Tribunal with a self-written memo, the same logic lets anyone suspend anyone.
