On 20 January 2025, President Trump issued Executive Order No. 14160, titled "Protecting the Meaning and Value of American Citizenship." The order provided that children born in the United States of parents who are unlawfully or temporarily present are not "subject to the jurisdiction" of the United States and thus do not qualify for citizenship under the Fourteenth Amendment.

The U.S. Supreme Court ruled today that the Fourteenth Amendment guarantees citizenship to children born in the United States to parents who are unlawfully or temporarily present in the country, striking down Trump's executive order attempting to deny automatic birthright citizenship.
