The Belgian State Council has declared unlawful the refusal issued by the Belgian Treasury in one of the cases concerning the unblocking of assets.
On September 11, 2026, the council annulled the Treasury's decision of July 15, 2024, which denied BKS Bank the unblocking of assets.
During the review of the case, the State Council found the decree of the Minister of Finance of December 13, 2023, which delegated authority to the Treasury, to be unlawful and subject to cancellation.
Experts at BGP Litigation note that all decisions made by the Treasury regarding the unblocking of assets in Euroclear can now be challenged. Any investor who has already received a refusal can refer to the new decision of the State Council.
